Terms of Service

These Terms are a general template and do not constitute legal advice. Your use of the services is subject to applicable local laws, including in the US, Australia, Canada, and the UK.

1. Overview

These Terms govern your access to and use of Data Align AI websites, APIs, WordPress plugin(s), and related services (the “Services”). By accessing or using the Services you agree to be bound by these Terms.

2. Eligibility & Accounts

  • You must be able to form a binding contract and comply with these Terms.
  • If you create an account or API key, you are responsible for safeguarding credentials and all activities under your account.

3. Acceptable Use

  • Do not misuse the Services or interfere with their normal operation.
  • Do not reverse engineer, decompile, or attempt to derive source code except as permitted by law.
  • Do not use the Services to infringe IP, violate privacy, or upload unlawful content.

4. Your Content & License

You retain ownership of your product and store content. You grant us a worldwide, non-exclusive license to process, store, and transmit content as needed to provide the Services and as described in the documentation.

5. Intellectual Property

Data Align AI and its licensors retain all rights, title, and interest in the Services, including software, documentation, and trademarks.

6. Third-Party Services

The Services may interoperate with third-party plugins, APIs, or platforms (e.g., WordPress, WooCommerce, SEO plugins). Your use of third-party services is subject to their terms.

7. Beta & Experimental Features

We may offer beta features for evaluation. They are provided as-is, may change or be discontinued, and may have additional limitations.

8. Fees

We may offer free and paid tiers. Fees, billing cycles, and usage limits are described on the pricing page. Taxes may apply based on your location.

9. Disclaimers

To the fullest extent permitted by law, the Services are provided “as is” and “as available”. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the fullest extent permitted by law, neither we nor our suppliers will be liable for indirect, incidental, special, consequential, or exemplary damages, or loss of data, revenues, or profits.

Our aggregate liability for all claims relating to the Services will not exceed the greater of (a) amounts paid by you in the 12 months before the event giving rise to liability, or (b) USD $100.

Nothing in these Terms excludes liability that cannot be excluded under applicable law (e.g., certain consumer guarantees in Australia).

11. Indemnity

You agree to indemnify and hold us harmless from claims arising from your use of the Services, your content, or your violation of these Terms.

12. Termination

You may stop using the Services at any time. We may suspend or terminate access for breach or risk to the Services. Upon termination, your license ends and you must cease use.

13. Compliance & Region-Specific Terms

  • United States: For users in the U.S., including California, you receive consumer notices and rights as outlined in our Privacy Policy (see U.S. State Privacy Notice).
  • United Kingdom: UK users are protected under the UK GDPR and Data Protection Act 2018. See Privacy Policy for controller details and rights.
  • Canada: Canadian users are protected under PIPEDA. See Privacy Policy for access and correction rights.
  • Australia: Australian users benefit from the Privacy Act 1988 and Australian Consumer Law. Consumer guarantees that cannot be excluded remain in force.

14. Governing Law & Disputes

Unless prohibited by local law, these Terms are governed by the laws of your place of residence without regard to conflict of law principles. If a court requires a specific venue, the venue will be a competent court in your country, state, or region.

15. Changes to Terms

We may update these Terms from time to time. Changes take effect when posted. Your continued use of the Services constitutes acceptance of the updated Terms.
